When History Repeats Itself: Company Fined Over $800k for Decades of Warnings Ignored

It was just days before Christmas in 2023 when a wife began to worry. Her husband hadn’t returned home from his shift at the tank-cleaning company where he worked. Calls went unanswered.

Hours later, her worst fear was confirmed — he had been found unresponsive inside a tanker, overcome by carbon monoxide.

A life lost. A family broken. And for this company fined, it was another preventable tragedy.


A Familiar Pattern

Unfortunately, this wasn’t the company’s first fatality and far from their first offense.

The company had a long history of sending workers into confined spaces without adequate training, protective equipment, or air monitoring — and ignoring the consequences when things went wrong. Despite years of citations, warnings, and opportunities to change, leadership failed to act.


December 1999: Two Workers Never Came Home

Almost exactly 24 years earlier, two men were sent to clean the inside of a tank that once held hazardous chemicals. They were given no respiratory protection.

When they didn’t come out, a coworker went to check on them and found both collapsed on the floor, overcome by toxic fumes. The company delayed calling for medical assistance for nearly four hours. Responders had to recover the bodies with masks and supplied air.

OSHA cited the employer and required retraining, PPE, and confined space procedures. The company agreed — but never followed through.


May 1999: The First Warning

Just months before that double fatality, another worker had already been injured in almost the exact same way.

He was told to enter a sludge tank with only a thin coverall, a shovel, and a bucket. Within minutes, he began suffering chemical burns and struggled to breathe.

Instead of helping, management refused to let him wash off or seek care. Hours later, he drove himself to the hospital. Alone.

That moment could have been the company’s turning point. But it wasn’t.


2023: A Tragedy Reborn

Fast forward 24 years. The same company. The same conditions. The same outcome.

A worker entered a tank without proper ventilation or monitoring. He never made it out. This time, OSHA issued $810,000 in penalties for eight repeat violations — but once again, the fines came too late to save a life.


Lessons Ignored Are Lessons Repeated

Unlike most of the articles in Occupational Lessons Learned/Cautionary Tales, this one doesn’t end with a traditional lesson that was learned. On the contrary, this company exhibited years of failing to learn a lesson at all.

But what we’ve learned and what we want others to learn is that safety failures rarely come from a lack of knowledge. They come from a lack of leadership.

This company had every opportunity to change course. They were warned, trained, cited, and even given specific corrective steps. But leadership chose inaction — and that choice led to devastating consequences.

Because when leaders don’t value safety, neither will their teams.


Why We Tell This Story

We tell this story for the leaders who may have relaxed their guard — who put off updating a safety program, postponed a refresher training, or assumed “it won’t happen here.” And we tell it for the workers who may recognize some of these same patterns in their own workplaces.

Speak up. Be your own advocate. If something feels unsafe, say so. If a policy hasn’t been followed, question it. The right to go home safe is not negotiable — and silence is never worth the risk.
